About This Book
The need for specialized judicial mechanisms to expedite the resolution of commercial disputes was strongly felt in India's growing legal and business ecosystem. Recognizing this necessity, the Parliament enacted the Commercial Courts Act, 2015, a comprehensive and self-contained legislation designed to streamline commercial litigation, ensure prompt redressal of disputes, and enhance the efficiency of the legal process.
Since then the jurisprudence surrounding commercial law has significantly evolved. Bunch of judgments are delivered by the Hon'ble Supreme Court and the High Courts across the country, interpreting and applying various provisions of the Act. This growing body of case laws and the consistent demand from practitioners has led to the need for an updated and enriched edition, an exhaustive Compendium. Hence this exercise.
This Part offers sample formats for Pre-Institution Mediation forms, plaints, written statements, and forms of admission and denial. These formats are aimed at helping parties and practitioners alike in the efficient drafting of pleadings and in navigating procedural requirements with clarity and confidence.
Each decision has been carefully selected and analyzed in a manner that allows practitioners to extract the essential legal principles accurately.
